Zihar- ‘You are for me like the back of my mother’

Respected Mufti Saheb

Kindly provide clarity on a husband calling his wife ummi. This occurs when the husband is with the children and out of excitement says this without any intention of implying she is my mother.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

 If the husband calls his wife ‘’ummi’’ in the presence of his children, he is referring to her as the mother of her children.[1] There are no negative implications in referring to his wife as ‘’ummi’’ in such a context.

وإذا ظاهر الرجل من امرأته فعليه من الكفارة ما قال الله تعالى في كتابه: {فَتَحْرِيرُ رَقَبَةٍ مِنْ قَبْلِ أَنْ يَتَمَاسَّا … فَمَنْ لَمْ يكفر، فبلغ ذلك النبي – صلى الله عليه وسلم -، فأمره أن يستغفر ربه ولا يعود حتى يكفر يَجِدْ فَصِيَامُ شَهْرَيْنِ مُتَتَابِعَيْنِ مِنْ قَبْلِ أَنْ يَتَمَاسَّا} – إلى قوله – {سِتِّينَ مِسْكِينًا} (4). فإن جامع قبل أن يكفر استغفر ربه ولم يعد حتى يكفر ولم يكن (5) عليه فيما صنع كفارة. بلغنا عن رسول الله – صلى الله عليه وسلم – أن رجلاً ظاهر من امرأته فوقع عليها قبل أن

إذا قال الزوج لامرأته: أنت علي كظهر أمي فقد حرمت عليه ولا يحل له وطؤه ا ولا لمسها ولا تقبيلها حتى يكفر عن ظهاره فإن وطئها قبل أن يكفر استغفر

الله تعالى ولا شيء عليه غير الكفارة الأولى ولا يعاودها حتى يكفر

وإن عنى المنزلة والكرامة (3) فليس بظهار. وإن لم تكن (4) له نية في تحريم ولا غيره فليس بشيء في قول أبي حنيفة.

 

مختصر القدوري (ص: 165)

قال: أنت علي مثل أمي رجع إلى نيته

فإن قال أردت الكرامة فهو كما قال وإن قال: أردت الظهار فهو ظهار وإن قال: أردت الطلاق فهو طلاق بائن وإن لم يكن له نية فليس شيء
