What To Do if the Husband and Wife Are From Two Different Madhabs

Answered as per Hanafi Fiqh by DarulIftaBirmingham

Question

I am Hanafi, I have studied Hanafi theology. My husband is from the Middle East and he follows Ibn Taymiyyah, more in accordance with Hanbali madhab but is Salafi, we have a difference in opinions in the house I wanted to know when the matter is concerning us what do we do? As there are some issues in which the husband has authority in does his madhab/belief come first?

In the name of Allah, the Most Gracious, the Most Merciful

Answer:

The difference in the madhahib is reconcilable as each is derived from Quran and Sunnah. That means the differences are only in subsidiary issues of fiqh. This should not matter as much in day-to-day marriage life. As for particular issues please send us more details or consult your local imam/mufti regarding particular issues. Generally, the husband’s words and orders should be obeyed but we recommended you either send us a particular issue or consult your local imam/mufti.

Only Allah knows best
