Question:
Is it Fardh, Waajib or Sunnat to establish an Islamic Khilafat?
Will we be sinful for not actively attempting to establish a Khilafah?
If a Darul Islam is established, will it be Fardh to make Hijrat towards this area?
Answer:
1) It is Waajib to establish an Islamic Khilafah, due to the consensus of the Sahaaba Radhiyallahu Anhum.
2) We will not comment whether not actively attempting to establish a Khilafah is a sin or not, due to not finding a proof in this regard. But what we can say is Allah Taa’la has promised to bestow it upon the believers, provided that they are firm on Deen and do good deeds. Allah Ta’aala says in the Holy Qur’aan;
وَعَدَ ٱللَّهُ ٱلَّذِينَ ءَامَنُواْ مِنكُمۡ وَعَمِلُواْ ٱلصَّٰلِحَٰتِ لَيَسۡتَخۡلِفَنَّهُمۡ فِي ٱلۡأَرۡضِ كَمَا ٱسۡتَخۡلَفَ ٱلَّذِينَ مِن قَبۡلِهِمۡ وَلَيُمَكِّنَنَّ لَهُمۡ دِينَهُمُ ٱلَّذِي ٱرۡتَضَىٰ لَهُمۡ وَلَيُبَدِّلَنَّهُم مِّنۢ بَعۡدِ خَوۡفِهِمۡ أَمۡنٗاۚ يَعۡبُدُونَنِي لَا يُشۡرِكُونَ بِي شَيۡـٔٗاۚ وَمَن كَفَرَ بَعۡدَ ذَٰلِكَ فَأُوْلَٰٓئِكَ هُمُ ٱلۡفَٰسِقُونَ.
“Allah has promised those of you who have Imaan and who do good actions that He will definitely make them successors (rulers) on earth just as He had made those before them successors. And He will certainly grant (great) strength to the Deen that He has chosen for them and will certainly replace their fear with peace (on condition that) they worship Me and do not ascribe any as partner to Myself. Those who are ungrateful after this are sinful indeed.”
(Surah An-Noor-55)
The above mentioned verse clearly indicates that in order to be successors, get the upper hand and have Khilafah, true Imaan and righteous deeds are required. For that reason, we see the Tableeghi Jamaat making great effort on people’s Imaan and giving them encouragement toward good deeds. Once the Imaan of the Muslim Ummah becomes strong, Insha-Allah we will be given back Islamic Khilafah. Thereby every one of us should ask ourselves what am I doing to help the situation? As for now, we should make an effort on our Imaan and the Imaan of our families and the entire Ummah. Together with that we should have a burning desire for Khilafah to come back and lot of Du’aa is required for this.
3) It will not be Waajib to make Hijrat toward Darul Islaam as long a person can protect his Deen, his life, his honour, his family and his wealth.

ابْتِدَاءُ الْعِدَّةِ فِي الطَّلَاقِ عَقِيبَ الطَّلَاقِ وَفِي الْوَفَاةِ عَقِيبَ الْوَفَاةِ، فَإِنْ لَمْ تَعْلَمْ بِالطَّلَاقِ أَوْ الْوَفَاةِ حَتَّى مَضَتْ مُدَّةُ الْعِدَّةِ فَقَدْ انْقَضَتْ عِدَّتُهَا كَذَا فِي الْهِدَايَةِ. (الفتاوى الهندية ج١ ص532)
(وَمُعْتَدَّةُ مَوْتٍ تَخْرُجُ فِي الْجَدِيدَيْنِ وَتَبِيتُ) أَكْثَرَ اللَّيْلِ (فِي مَنْزِلِهَا) لِأَنَّ نَفَقَتَهَا عَلَيْهَا فَتَحْتَاجُ لِلْخُرُوجِ، حَتَّى لَوْ كَانَ عِنْدَهَا كِفَايَتُهَا صَارَتْ كَالْمُطَلَّقَةِ فَلَا يَحِلُّ لَهَا الْخُرُوجُ فَتْحٌ. وَجَوَّزَ فِي الْقُنْيَةِ خُرُوجَهَا لِإِصْلَاحِ مَا لَا بُدَّ لَهَا مِنْهُ كَزِرَاعَةٍ وَلَا وَكِيلَ لَهَا (قَوْلُهُ: فِي الْجَدِيدَيْنِ) أَيْ اللَّيْلِ وَالنَّهَارِ فَإِنَّهُمَا يَتَجَدَّدَانِ دَائِمًا ط. (قَوْلُهُ: لِأَنَّ نَفَقَتَهَا عَلَيْهَا) أَيْ لَمْ تَسْقُطْ بِاخْتِيَارِهَا، بِخِلَافِ الْمُخْتَلِعَةِ كَمَا مَرَّ وَهَذَا بَيَانٌ لِلْفَرْقِ بَيْنَ مُعْتَدَّةِ الْمَوْتِ وَمُعْتَدَّةِ الطَّلَاقِ. قَالَ فِي الْهِدَايَةِ: وَأَمَّا الْمُتَوَفَّى عَنْهَا زَوْجُهَا فَلِأَنَّهُ لَا نَفَقَةَ لَهَا فَتَحْتَاجُ إلَى الْخُرُوجِ نَهَارًا لِطَلَبِ الْمَعَاشِ وَقَدْ يَمْتَدُّ إلَى أَنْ يَهْجُمَ اللَّيْلُ وَلَا كَذَلِكَ الْمُطَلَّقَةُ لِأَنَّ النَّفَقَةَ دَارَّةٌ عَلَيْهَا مِنْ مَالِ زَوْجِهَا. اهـ. قَالَ فِي الْفَتْحِ: وَالْحَاصِلُ أَنَّ مَدَارَ حِلِّ خُرُوجِهَا بِسَبَبِ قِيَامِ شُغْلِ الْمَعِيشَةِ فَيَتَقَدَّرُ بِقَدْرِهِ، فَمَتَى انْقَضَتْ حَاجَتُهَا لَا يَحِلُّ لَهَا بَعْدَ ذَلِكَ صَرْفُ الزَّمَانِ خَارِجَ بَيْتِهَا. اهـ. (قَوْلُهُ وَمُعْتَدَّةُ الْمَوْتِ تَخْرُجُ يَوْمًا وَبَعْضَ اللَّيْلِ) لِتَكْتَسِبَ لِأَجْلِ قِيَامِ الْمَعِيشَةِ؛ لِأَنَّهُ لَا نَفَقَةَ لَهَا حَتَّى لَوْ كَانَ عِنْدَهَا كِفَايَتُهَا صَارَتْ كَالْمُطَلَّقَةِ فَلَا يَحِلُّ لَهَا أَنْ تَخْرُجَ لِزِيَارَةٍ وَلَا لِغَيْرِهَا لَيْلًا وَلَا نَهَارًا. وَالْحَاصِلُ أَنَّ مَدَارَ الْحِلِّ كَوْنُ خُرُوجِهَا بِسَبَبِ قِيَامِ شُغْلِ الْمَعِيشَةِ فَيَتَقَدَّرُ بِقَدْرِهِ فَمَتَى انْقَضَتْ حَاجَتُهَا لَا يَحِلُّ لَهَا بَعْدَ ذَلِكَ صَرْفُ الزَّمَانِ خَارِجَ بَيْتِهَا كَذَا فِي فَتْحِ الْقَدِيرِ (البحر الرائق شرح كنز الدقائق ج4 ص166)
