Ruling on wealth earned whilst wearing a haram item

Answered as per Hanafi Fiqh by Askimam.org

Assalamu’alaikum warahmatullahi wabarakatuh

What is the ruling on wealth gained/earned while wearing or using haram products which earned through haram way before such as working in a bank or maybe from stealing?

a) For example haram bag when being used in your activity, including when you are working, bringing documents in this bag. What is the ruling on the money/wealth earned when you use this bag to work (permissible work), will it be haram wealth? Or mixed halal & haram wealth?

b) What if its haram clothes or haram shoes, and you use it in your daily activity such as when paying electricity, or buying food and water using halal money. Will this make what you bought haram? Or mixed halal & haram?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Haraam earnings have negative consequences. You refer to two examples, stealing and working in a bank.

Stealing is haram. Whatever is stolen must be returned to the rightful owner. It is haraam to use a stolen item. If one performs salaah with a stolen item, for example clothes etc, then that exterminates the salaah. Consider the following hadith:

 عَنْ ابْنِ عُمَرَ – رضي الله عنه – قَالَ: قَالَ رَسُولُ اللهِ – صلى الله عليه وسلم -: ” مَنْ اشْتَرَى ثَوْبًا بِعَشَرَةِ دَرَاهِمَ وَفِيهِ دِرْهَمٌ حَرَامٌ , لَمْ يَقْبَلْ اللهُ لَهُ صَلَاةً مَادَامَ عَلَيْهِ[1]

Translation: It has been reported from Abdullah Ibn Umar that Nabi (ﷺ) said:

Whoever buys a cloth for ten dirhams and one dirham is haram, Allah will not accept his Salaah as long as that cloth is upon him.

The income from the bank is not necessarily haraam. It also depends on the circumstances of an individual.
