Intention for makeup fast

Answered as per Hanafi Fiqh by Qibla.com

Answered by Shaykh Sohail Hanif, SunniPath Academy Teacher

I made firm intention at night to fast the next day but in the morning did not have much time for suhur so I did not intend to go through with the (Ramadan make-up) fast. Am I still fasting based on the first niyyah?

Answer:
In the Name of Allah, Most Gracious, Most Merciful

Assalamu alaykum

If one is fasting a Ramadan makeup fast then one’s intention must be made before dawn of the day that one intends to fast on. The intention that counts is what one last intended before the break of dawn. If, after maghrib, one intends to fast but then, just before dawn, one changes one’s mind, one is not fasting. (Ala’ al-Din Abidin, al-Hadiyya al-‘Ala’iyya, 155, ed. Muhammad Sa’id al-Burhani) Should one decide to fast after dawn it will count as a supererogatory fast and will not count as a makeup.
