Is the dowry pardoned in the transaction of Khul’a?

Answered as per Hanafi Fiqh by Jamia Binoria

I wanted to ask about Khul’a. Is the dowry pardoned in the transaction of Khul’a? Or half of it? If the girl is asking for the dowry then what will be the ruling?

الجواب حامدا و مصلیا

If the husband did not give the dowry and the wife, due to whatever compelling situation, is requesting Khul’a, then if the spouses agree upon Khul’a, the exchange for Khul’a will be whatever is agreed upon between them, whether it be the entire dowry or half of it. The husband is also free to request whatever he wants in exchange for Khul’a.
