Is it fair for the daughters of your grandfather to not get a share of the land?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
Assalamualikum My Late patternal grand father was having a land of about 30 acres, and He has three daughters and 7 sons, one of his three daughters is my mother. Note : this land was His great grand fathers not even his earned. now all of his children i mean my 7 uncles want to sell out this 30 acres, and they refused to give any of its share to their sisters (of whom one is my mother) could you please reply to my above issue, that how far is it fair, that the doughters of my grand father will not get any share of this land?

(Fatwa: 1271/1194=D/1429)

Allah Almighty has fixed the shares of women as He has fixed the shares of women; the details have been mentioned in the Holy Quran. After death of parents, the girls also have their shares in the inheritance like the boys. It is opposed to the ruling of the Holy Quran and absolutely a cruelty if girls are deprived of their shares. The Hadith says: whoever encroaches upon a span land of any one, he will be resurrected in he Day of Judgment with seven plates of the earth hanging around his neck.

In the abovementioned question, if your maternal grandfather also had died, then all the properties and other things left by the maternal grandparents shall be distributed into 17 shares; two shares for each of the seven boys and one share for each of the three girls.

Note: The above distribution shall be made after all due rights preceding the inheritance like debt, will etc.
