A specific inheritance case

Answered as per Hanafi Fiqh by Darulfiqh.com
The deceased was married at the time of death.   The deceased has a son who is a major and a daughter who is also a major.  The deceased has no parents and was married ANC.

Please tell me the inheritance?

Answer:

According to the Islamic Law of Succession and Inheritance, distribution of an estate will only commence after funeral expenses, debts (including legal costs) and bequests (if any) made to non-heirs – which will not exceed one-third(1/3) of the Estate after debts and funeral expenses have been settled. Thereafter, all assets form part of the Nett Estate and will have to be distributed according to the Islamic Law of Succession and Inheritance as per attached certificate.

Estate

In the above Estate, we have been advised that at the time of his demise, the deceased was survived by:

a) a wife

b) a son

c) a daughter

If the above information is correct according to the Islamic Laws of Inheritance and Succession, the Nett Estate will be divided into (24) equal shares and will be distributed as follows:

a) Wife receives:                                  03        shares

b) son receives :                                   14        shares

c) daughter receives:                        07        shares
