Is my divorce valid?

Answered as per Hanafi Fiqh by Askimam.org

I was having so much fights with my Wife so i decided to start thinking about divorce. But I then wanted to know if I would be getting any proposals after that, so I made a profile on a marital website and put my marital status as “anulled” and wrote below sentence in my “about me” section. I did that just to see if I will be getting any proposals, I lied I know I didnt do the right thing. But I am worried if my Nikkah is still valid.

“I had Nikkah, but never lived with her, had breakup before rukhsati. I can share details upon request. Please feel free to contact.”

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

The statement in the “about me” section is contrary to the reality of your situation. You live with your wife. There was no break up before rukhsati. Your marriage was not annulled[1]. You also did not intend divorcing your wife with such a statement. Accordingly, your statement constitutes a lie and which is a major sin. In principle, a lie regarding one’s marital status does not constitute divorce if you did not intend divorce. However, you should make tauba for the lie and don’t repeat the sin in future. The solution to marital disputes is not always in remarrying. That maybe akin to coming out from the pot to the frying pan. Address your marital disputes with dignity and adopt tolerance.
