My question is regarding Inheritance. If a divorce was to happen islamicaly does my wife take half of everything i own for example my house is under my name does she own half? What is the ruling for this particular scenario?
In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykumwa-rahmatullāhiwa-barakātuh.
Inheritance is upon the death of a person and not upon divorce.
According to the Shariah, marriage is separated from proprietary rights. If a divorce takes place, the divorced spouses are not entitled to the possession of the other by virtue of marriage. It is incorrect for a divorced person to claim the possession of his/her spouse. That will be regarded as usurpation which is clearly prohibited and a major sin. Allah says.
يَاأَيُّهَا الَّذِينَ آمَنُوا لَا تَأْكُلُوا أَمْوَالَكُمْ بَيْنَكُمْ بِالْبَاطِل(سورة النساء)
Translation: O you who believe, do not devour each other‘s property by false means (Surah: Nisaa verse, 29)
