Ambiguous words of talaaq

Urgent Question Please answer this question quickly as its causing lots of stress and tension. 1. The husband and wife were having argument related to how to handle their child politely and the husband got angry and said to his wife if you guys don’t want me here I wont stay here or I go. Later on when the wife asked the intention of what he said then he told that he didn’t have any bad intention but what he said was just a question and said that i only said ” if you dont want me and there is difference between I do ( that I go somewhere)and if u want i would go” And husband said he never had any bad intention ( meaning no intention of divorce). The wife then said if next time God forbid ( wife meant to say that if there’s again confusion or waswasa) just say No Bad intention and don’t elaborate on meaning of words as its risky and scary thing (wife meant that its too risky to talk about divorce issue) The husband said ok. Is Nikkah still valid? JazakAllah khair

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In principle, if the husband utters a word or a statement that has dual or multiple meanings and some of the meanings could mean divorce (talaaq), then divorce will take place only if the husband intended divorce with the word or statement. In that instance, one talaaqe-baain (irrevocable divorce) will take place, which terminates the nikaah immediately.

In the enquired situation, the husband did not intend divorce. Hence, the nikaah is still valid. [1]

(وَلَا يَقَعُ بِهَا) أَيْ وَلِهَذَا لَا يَقَعُ الطَّلَاقُ بِالْكِنَايَاتِ قَضَاءً (إلَّا بِنِيَّةٍ) أَيْ بِنِيَّةِ الزَّوْجِ، أَوْ الطَّلَاقِ مُضَافًا إلَى الْفَاعِلِ، أَوْ الْمَفْعُولِ (أَوْ دَلَالَةِ حَالٍ) ؛ لِأَنَّهَا غَيْرُ مَوْضُوعَةٍ لِلطَّلَاقِ بَلْ مَوْضُوعَةٌ لِمَا هُوَ أَعَمُّ مِنْهُ وَالْمُرَادُ بِدَلَالَةِ الْحَالِ الْحَالَةُ الظَّاهِرَةُ الْمُفِيدَةُ لِمَقْصُودِهِ وَفِيهِ إشَارَةٌ إلَى أَنَّ الْكِنَايَاتِ غَيْرُ مُؤَثِّرَةٍ بِدُونِ النِّيَّةِ وَدَلَالَةِ الْحَالِ

وَإِذَا لَمْ يَكُنْ صَرِيحًا كَانَ كِنَايَةً لِعَدَمِ الْوَاسِطَةِ وَالْكِنَايَةُ تَحْتَاجُ إلَى النِّيَّةِ

 [أَلْفَاظٍ يَقَعُ بِهَا الطَّلَاقُ الرَّجْعِيُّ]

قَالَ (وَأَمَّا الضَّرْبُ الثَّانِي وَهُوَ الْكِنَايَاتُ) لَمَّا فَرَغَ مِنْ الضَّرْبِ الْأَوَّلِ وَهُوَ الصَّرِيحُ شَرَعَ فِي بَيَانِ الضَّرْبِ الثَّانِي وَهُوَ الْكِنَايَاتُ. الْكِنَايَةُ: مَا اسْتَتَرَ الْمُرَادُ بِهِ.

وَحُكْمُهَا أَنَّهُ لَا يَجِبُ الْعَمَلُ بِهَا إلَّا بِالنِّيَّةِ أَوْ مَا يَقُومُ مَقَامَهَا مِنْ دَلَالَةِ الْحَالِ لِأَنَّهَا غَيْرُ مَوْضُوعَةٍ لِمَا اُسْتُعْمِلَتْ فِيهِ بَلْ تَحْتَمِلُهُ وَغَيْرَهُ فَلَا بُدَّ مِنْ التَّعْيِينِ أَوْ دَلَالَتِهِ
