Words that Sound like Talaaq

Answered as per Hanafi Fiqh by Askmufti.co.za

Q: My husband and I were discussing an issue on divorce that happened in some television program. Then jokingly he said to me this statement that ‘I give you … I give you …’ and he kept quiet. At that moment he didn’t say anything beyond ‘I give you’ and I asked him what are you giving me? He just used the word Taaq or Talaash. These two words sound very similar to Talaaq (divorce).

I thought that I heard the word Talaaq so I asked him whether he used the actual word talaaq. He said that he would never use this word as he never had any intention in using it and he said that he just used a word of Taaq or Talash that sounded like Talaaq so he could just joke with me.

But since then I have not been able to sleep properly as I think he did utter talaaq. Maybe at that time we were discussing divorce that’s why I had this talaaq word on my mind. I asked him a lot of times if he used the actual word and he promised in the name of Allah that he did not use the actual word Talaaq. He just used the word Taaq or Talaash that sounded like Talaaq.

Please do guide me in accordance with Quran and Sunnah as I am really depressed.

Should I believe what my husband is saying or should I believewhat I believe I heard, or is it better to be on the safe side and ask my husband to take me back in marriage front of two witnesses?

A. You can rest assured, talaaq does not occur by using the words your husband used. If he took an oath on Allah’s name that he never used the word talaaq neither did he intend talaaq, then no talaaq has occurred and you two are still husband and wife. There is nothing to worry about.

He should be advised not to play around with such matters.
