Zakat Question

Assalam Alaekum. I gave my zakat money to a family relative. I recently found out she is a Shia. Is my zakat valid, or do I have to give zakat again?

الجواب وباللہ التوفیق

Whoever has beliefs of infidelity, namely; believes in distortion of the Qur’an, or slanders Hazrat Ayesha (RA), it is not allowed to pay Zakat to such a person. But if given in error, the Zakat will be invalid and will have to be paid again to a genuine individual.

But if a person does not have infidel beliefs “kufriah aqaaid”, then Zakat will be allowed to pay to such a person. 

ولا يصح دفعها لكافر(مراقی الفلاح:باب المصرف ،۱/۲۷۲)

لَكِنْ صَرَّحَ فِي كِتَابِهِ الْمُسَايَرَةِ بِالِاتِّفَاقِ عَلَى تَكْفِيرِ الْمُخَالِفِ فِيمَا كَانَ مِنْ أُصُولِ الدِّينِ وَضَرُورِيَّاتِهِ: كَالْقَوْلِ بِقِدَمِ الْعَالَمِ، وَنَفْيِ حَشْرِ الْأَجْسَادِ، وَنَفْيِ الْعِلْمِ بِالْجُزْئِيَّاتِ، وَأَنَّ الْخِلَافَ فِي غَيْرِهِ كَنَفْيِ مَبَادِئِ الصِّفَاتِ، وَنَفْيِ عُمُومِ الْإِرَادَةِ، وَالْقَوْلُ بِخَلْقِ الْقُرْآنِ إلَخْ. وَكَذَا قَالَ فِي شَرْحِ مُنْيَةِ الْمُصَلِّي: إنَّ سَابَّ الشَّيْخَيْنِ وَمُنْكِرَ خِلَافَتِهِمَا مِمَّنْ بَنَاهُ عَلَى شُبْهَةٍ لَهُ لَا يَكْفُرُ، بِخِلَافِ مَنْ ادَّعَى أَنَّ عَلِيًّا إلَهٌ وَأَنَّ جِبْرِيلَ غَلِطَ؛ لِأَنَّ ذَلِكَ لَيْسَ عَنْ شُبْهَةٍ وَاسْتِفْرَاغِ وُسْعٍ فِي الِاجْتِهَادِ بَلْ مَحْضُ هَوًى اهـ وَتَمَامُهُ فِيهِ. قُلْت: وَكَذَا يَكْفُرُ قَاذِفُ عَائِشَةَ وَمُنْكِرُ صُحْبَةِ أَبِيهَا؛ لِأَنَّ ذَلِكَ تَكْذِيبُ صَرِيحِ الْقُرْآنِ كَمَا مَرَّ فِي الْبَابِ السَّابِقِ(رد المحتار:۴/۲۳۶)
