Usage of a Cadaver’s Organs

Answered as per Hanafi Fiqh by Mahmoodiyah

Question:

Peace on you and your family and all salutations on the prophet, peace be upon him.

Many thanks for you speedily response. One more question if

I may, what about donating your organs after death, for example, you die in a car crash but your organs can still be used to save one or two lives. Would that be permissible and if so, can you refer me to any Qur’anic verse or Hadith to substantiate your answer.

Using an organ of a corpse is a controversial issue amongst the jurists.  Some jurists are of the opinion that it is not permissible to use organs of a corpse under any circumstances, though he may have given permission to do so before his death.  Other jurists e.g. Moulana Khalid Saifullah Rahmani and the members of Majlisul Majma’il Fiqhil Islaami in Makkah, are of the opinion that it will be permissible to use the organs of the corpse for transplant in the case of dire need, but it would be essentially required that the person give his/her permission in this regard when he/she was alive.
