Is it permissible to marry through a phone call?

Answered as per Hanafi Fiqh by Jamia Binoria

Is it permissible to marry through a phone call? If someone wants to marry without the permission of their guardian, and the boy brings witnesses which are not present where the girl had accepted the proposal, rather they are present with the boy, and the girl calls another person and makes him her wakeel, would the marriage be valid?

الجواب حامدا و مصلیا

In usual situations, the marriage that is done by means of a phone call is not valid due to the absence of certain conditions. But if the girl gives the authority to get her married to someone present in the gathering by making him her wakeel, and that person proposes on her behalf or accepts the boy’s proposal in the presence of the witnesses present in the gathering, then this marriage will be valid on the condition that they are compatible and Mahr Mithl will be given to the girl as dowry. If one marries someone incompatible without the permission of their guardian, then this marriage will not be valid as per Shari’ah. Thinking that such a marriage is acceptable and then spending life like spouses is not permissible and Haram.
