Inheritance Scenario 2

Answered as per Hanafi Fiqh by DarulIftaBirmingham

A man has a wife and two daughters.
he also has 5 brothers and 3 sisters.
if this person dies what would be the proportion of inheritance.

Please oblige with a fatwa
Thanks

In the name of Allah, Most Compassionate, Most Merciful.

According to the Islamic law of inheritance, distribution of an estate will only commence after funeral expenses, debts and if any bequests made to non-heirs, which do not exceed one-third of the estate after debts and funeral expenses, have been settled. Thereafter in the situation mentioned in your question, the net estate of the man/husband will be divided into 312 equal shares.

The wife will receive 39 shares; each daughter will receive 104 shares, each brother will receive 10 shares with the sisters receiving 5 shares each.

13                                                                                                                    312

3                                                                                                                      24

3 Sisters            5 Brothers           2 Daughters                 Wife

                                                            2/3                         1/8

                 5                                         16/24                      3/24

                  65                                      208                         39

5 each               10 each                   104 each

And Allah knows best.
