Fidyah to Father in Law

Answered as per Hanafi Fiqh by Askmufti.co.za

Q: I am a diabetic and follow the shafi mathab. My fidyah works out to be R375 for 30 days. Can I pay this fidyah money to my father-in-law who is 65 and gets a grant and pension every month?

A. If the grant, pension, etc. which he receives is sufficient for him; the Fidyah cannot be given to him. If the grant, etc. is not sufficient for his needs and there is no family member (son, etc) to see to his needs, which is above his income, the Fidyah can be given to him. (Haashiyatul Bujayrami alal Khateeb 6:362; Al Majmu Sharhul Muhazzab 6:229)
