Q: I want to know that if a man divorces his wife when she has her monthly, is it counted?
A: The Talaaq issued when the wife is in the state of haidh is valid. However issuing the talaaq in this condition is impermissible and one will be sinful. If one had issued the talaaq in this condition, then one should sincerely repent to Allah Ta’ala and make a firm resolve that one will not repeat this in the future. The Hadith teaches that if one had issued the talaaq in the state of haidh, then one should immediately make amends through revoking the talaaq and take the wife back in the nikaah. Thereafter if one intends to divorce, he should wait until the haidh passes and the tuhr after the haidh also passes. Once the wife completes the following haidh and becomes clean, then the husband may issue the talaaq in the state of tuhr if he wishes.

عن عبد الله بن عمر رضي الله عنهما أنه طلق امرأته وهي حائض على عهد رسول الله صلى الله عليه وسلم فسأل عمر بن الخطاب رسول الله صلى الله عليه وسلم عن ذلك فقال رسول الله صلى الله عليه وسلم مره فليراجعها ثم ليمسكها حتى تطهر ثم تحيض ثم تطهر ثم إن شاء أمسك بعد وإن شاء طلق قبل أن يمس فتلك العدة التي أمر الله أن تطلق لها النساء (صحيح البخاري # 5251)
