1. When one reaches Makkah (either for Haj, Umra or a resident of makkah returning from a journey away from Meeqat) is it mandatory(wajib) to do tawaaf? If one misses and say directly goes to mina, then what is the ruling?

Answer:
In the Name of Allah, Most Gracious, Most Merciful

In the name of Allah, the Inspirer of truth.

1. According to the Hanafi school, it is necessary for anyone coming to Makka from outside the miqat that they put on their ihram from there and at least perform an umra. This also applies to the resident of Makka who may have traveled outside the miqat (Radd al-muhtar). A hadith in Sunan al-Bayhaqi says that “No body should enter into Makka without an ihram.

2. Rami is wajib. A woman is also obligated as men to perform the rami, the only difference being that it is superior for her to go at night due to their being less crowds at he time. It is not permissible for someone to do it on her behalf unless the woman is unable to go even at night because of some disability, sickness, or too much rush.

Therefore, in the case in question, a dum will be necessary on the woman if it had been possible for her to have performed it at night, but she did not go, even though she had somebody perform it for her. If it had not been possible for her to go at all then no dum will be wajib on her (Radd al-Muhtar).

[ تَتِمَّةٌ ] يُسْتَثْنَى مِنْ الْإِطْلَاقِ الْمَارِّ فِي وُجُوبِ الْجَزَاءِ مَا فِي اللُّبَابِ : لَوْ تَرَكَ شَيْئًا مِنْ الْوَاجِبَاتِ بِعُذْرٍ لَا شَيْءَ عَلَيْهِ عَلَى مَا فِي الْبَدَائِعِ . وَأَطْلَقَ بَعْضُهُمْ وُجُوبَهُ فِيهَا إلَّا فِيمَا وَرَدَ النَّصُّ بِهِ ,
