Displaying pictures of the deceased

Q: If pictures of a deceased person are being displayed, who will be sinful, the deceased or the living?

Bismillaah

A: If the deceased was pleased with his photo being taken, then both will be sinful, the person who displays the photo as well as the deceased. However, if the deceased did not have knowledge of his photo being taken or he made tawba from this sin and informed others that they should destroy his photos if they have any, or he had his photos in some legal or official documentation (e.g. passport, ID, etc) and he was not at all aware that his photos will be displayed before people after his demise, then in this case, only the person who displays the photo will be sinful. As a precautionary measure, people should make a bequest  that their passports, ID’s, etc that contain their photos should be destroyed immediately after their demise.

عن مسروق عن عبد الله قال قال رسول الله صلى الله عليه و سلم إن من أشد الناس عذابا يوم القيامة المصورون وقال أحمد المصورين (سنن النسائي رقم 5364  ، صحيح البخاري رقم 5606)

عن عبد الرحمن بن القاسم عن أبيه أنه سمع عائشة تقول دخل علي رسول الله صلى الله عليه وسلم وقد سترت سهوة لي بقرام فيه تماثيل فلما رآه هتكه وتلون وجهه وقال يا عائشة أشد الناس عذابا عند الله يوم القيامة الذين يضاهون بخلق الله قالت عائشة فقطعناه فجعلنا منه وسادة أو وسادتين (صحيح مسلم رقم  2107 ، سنن النسائي رقم 5356)

إنما يعذب الميت ببكاء أهله إذا أوصى بذلك.(الدر المختار 2/246)

قال العلامة ابن عابدين – رحمه الله -: (قوله إنما يعذب إلخ) قال بعضهم: يعذب لما في الحديث «إن الميت ليعذب ببكاء أهله عليه» وقال عامة العلماء: لا {ولا تزر وازرة وزر أخرى}  وتأويل الحديث أنهم في ذلك الزمان كانوا يوصون بالنوح، فقال – عليه الصلاة والسلام – ذلك بحر عن الظهيرية وفي شرح التكملة أن المراد من الحديث الندب والنياحة. وعن عائشة – رضي الله تعالى عنها – «أن النبي – صلى الله عليه وسلم – قال ذلك لما مر على قوم يبكون على يهودي فقال: إنه ليعذب وهم يبكون عليه» . اهـ.(رد المحتار 2/246)

About 2 years ago I had very severe problems with doubts in taharah and salat. AlhamduLillah, these times are far away, and I feel myself much more comfortable. But unfortunately now I suffer from some new doubts which appeared recently. The first problem is regarding materials which doesn’t penetrate water. Before wudhu I’m in doubt whether there are some of them on my heels and near nails. For example, if I have few yarns stuck to my heels, I don’t know whether they are synthetic ones (which don’t penetrate water) or not. Because there are just a few yarns, I can’t advocate whether they penetrate water or not. Also sometimes I find hair stuck to my nails or heels, and again I’m in doubt whether it penetrates water or not. Also if I have some dirt, I’m also in doubt whether it contains some small amount of water-not-penetrating materials. So, my wudhu becomes quite a long procedure, where I try to look at my heels and nails thoroughly trying to remove all the dirt, yarns, stuck pieces of hair. The second problem is in washing my face. I know that we can’t wash one limb with water which was used for washing another limb. So the doubt is as follows: if washing the face my palms will touch hair, I start to think, that on my hands there is water which was used washing my hair, not the face, so I wash my hands, and continue washing the face with new water. The other problem is that I don’t know what part of eyes should I wash – I understand that we don’t need to wash eyes themselves, but what’s about the red area which is near roots of eyelashes (above, under, right and left to eyes)?
