When is the Actual Start of ‘Iddah?

Answered as per Hanafi Fiqh by Mathabah.org

Question:

My question is about ‘iddah (waiting period before remarriage) when the husband dies. When exactly does the count of the ‘iddah days start? Is it immediately after the husband dies including the day of his death or is it the day the husband gets buried.

Answer:

بِسْمِ اللهِ الرَّحْمنِ الرَّحِيْم

In the name of Allāh, Most Gracious, Most Merciful.

Jazāk Allāh Khayr/ Thank you for contacting Mathabah Institute.

The ‘iddah in the described scenario starts the day after the husband has passed away. The complete period of 130 full days must be observed in ‘iddah. – (See: Al-Badā’i Al-Ṣanā’i, Vol 3, Page 195, Dār Al-Kutub Al-‘Ilmiyyah[1])

“And those who are taken in death among you and leave wives behind, [they, the wives, shall] wait [precisely] four months and ten [days].” – (Qur’ān 2:234)[2]

Only Allāh knows best.
