If I can’t retrieve my stolen wealth, is it permissible to give it away as charity?

My wealth was stolen and there is no hope in getting it back. If I intend it as charity then what will be its ruling? Can I intend for it to be charity?

Charity is when someone gives of his wealth to someone else by choice, and this is not the case when it comes to stolen wealth. However, one can forgive the one who stole his wealth, which is indeed a very great deed, for which the forgiver will be rewarded and the thief will not be taken to task for his action in the hereafter.
