Difference in Zakâte for halaaq & istihlaaq? Pay Zakâte if money spent first?

Assalamualeikoum. Respected Mufti Sahib. Can Mufti Sahib, give me jawaab to this two following question. 1 – Is there any difference in Zakâte between halaaq (هلاك) and istihlaaq (استهلاك). 2 – If after the Shar’ee year somebody have 10000 euros. His zakate will be 250 euros. But before he give his zakate, he spend all 10000 rands (ex : he bought a car or food, any think). Must he paid his 250 rands zakaate.

(1) Yes, in zakah chapter there is difference in halak and istihlak. The wealth on which zakah is wajib in case it is damaged, zakah will no longer remain wajib, but in case of istihlak (destroying) the zakah will remain obligatory, as it is mentioned in al-Dur al-Mukhtar

ولا فى هالك بعد وجوبها بخلافا المستهلك بعد الحول لوجود التعدي

The above mentioned question falls in the category of istihlak, hence zakah will not be dropped from the owner of wealth. He will have to pay 250 Euro in zakah.

كما فى الرد المختار . تتمة : حكم النقود مثل مال التجارة : ففى الفتح: رجل له ألف حال حولها فاشترى بها عبداً للتجارة فما شاء أو عروضاً للتجارة فهلكت ، بطلت عنه الزكوةولو كان العبد للخدمة ، ثم تسقط بموته و تمامه فيه (درمختار مع الشامى كتاب الزكوة باب زكوة الغنم 3/207، 208).
