Should I pay zakat on land not for sale or business?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
I am a Pakistani doctor working in Saudi Arabia. I donot have any house. I have about 6000 US dollars as saving and about 300 grams gold. I have purchased a piece of land for construction of my house. I also have some (3) pieces of land (PLOTS) for construction of small houses. My plan is to give these small pieces of land to my children, especially daughters (I donot have any plan to sell them at this moment). I am finding it difficult to calculate Zakat for me. Should I pay zakat on these small pieces of land which are not for sale? (Not for business). Kindly help me in calculation of zakat.

Answer

(Fatwa: 1737/1533=B)

There is no zakah on the small pieces of lands which are for house purpose, not for business. If you like to distribute the property among your children then you should give them equally. It is infringing upon ones rights to give only the sons and deprive the daughters or give only the daughters and deprive the sons, it is unlawful.
