Is my nikaah still valid despite me saying “talaq doonga” thrice?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
Assalam walaikum, Approximately a year and a half back my wife with my permission went to my in laws place for a week and during that period we had some heated arguments over the phone. She was pregnant at that time with my second child. In anger and without knowledge I told her over phone that “main tumhare maa baap ko gawah rakhkar talaq doonga, talaq doonga, talaq doonga” She was the only one listening to me over phone. My wife is now concerned and says that the talaq is over as I uttered it thrice. My intention was not to give talaq. Please advise whether talaq is completed or my nikaah is still valid.

(Fatwa: 1691/1218/L=1431)

If you pronounced the same words and your wife confirms the same then in the question mentioned no talaq took place on your wife. Because “main tumhare maa baap ko gawah rakhkar talaq doonga, talaq doonga, talaq doonga” is the promise of talaq, and no talaq takes place by promising talaq. However, if your wife says something else, then carry this case to the Local Sharai Punchayat; they shall settle the matter after taking the statements of both of you.
