Beginning the Fast in One Country and Ending in Another

Answered according to Shafi'i Fiqh by Shafiifiqh.com

Question:

Assalamu Alaikum Wa Rahmathullahi Wa Barakathuhu,

Respected Mufti, Here is my question.

I begin my fast in UAE and then I travel to India (where Ramadan was declared a day later) in between Ramadan and be in India till the end of Ramadan.

Case 1: If Ramadan is for 29 days, do I have to fast the 30th day in India.

Case 2: If Ramadan is for 30 days, do I have to fast the 31st day in India. If I don’t need to fast the 31st day, can I make up for a fast missed during Ramadan of the same year?

I would appreciate your quick reply since I am facing this scenario this Ramadan.

Country: United Arab Emirates

Answer:

Wa alaykum salam wa rahmatuLlahi wa barakatuHu,

In the instance that one leaves the country where he started fasting, and travels to another, then he has become from amongst the people of the second. Thus, in the first case, he must complete 30 days if India is fasting that day.

In the second case, the relied-upon opinion is that even if one has fasted 30 days, then he still needs to fast with the country he traveled to. On this point, there is also a view that one should break his fast and not proceed to fast 31 days. Adhra’i supported this view.

In the case that one would travel and find that he only fasted 28 days and the country he is in is making Eid, he should make Eid and make-up a day.
