How to distribute inheritance according to Shariah with mother, brother, and sisters?

Answered as per Hanafi Fiqh by Muftisays.com
Assalamu alaikum. Thank you for a superb web site.

I follow Hanafi school of thought. I have began to write a will, and have considered the maximum of 1/3 bequeath to no heirs and costs of burial etc. but am seriously stuck on one matter – My father died, Which leaves my mum, 1 brother and 2 sisters. Please can you advise how I can distribute the shares according to shariah?

Answer
بسم الله الرحمن الرحيم

In the above mentioned case, in the event that you are unmarried and have no children and the brothers and sisters mentioned are born from the same father and mother then the assets will be distributed, after expenses, as followed:

The remaining asset will be divided into 24 parts from which the mother will be given 4 parts, the brother will be given 10 parts and the remaining 10 parts will be divided between the sisters getting 5 parts each. فقط

Public Notes

Note: It is essential that all Muslims create a will whilst alive as in the U.K. and many other countries; the law, in the event a person dies intestate, distributes the wealth unislamically.

Additionally to the writer of this question, whilst stating the exact proportion has its advantages it will be advisable to keep the Will slightly general i.e. suggesting the methodology, in terms of fiqh, which the executor should adopt so that it is robust enough and need not be changed in the event your circumstance changes.
