Dividing Inheritance: Settling My Father’s Debt to My Grandfather

Q: My father owed my grandfather R40 000. Its been few years since my grandfather passed away. My father is now able to pay of the debts which will go to the heirs (none of whom have passed away) as inheritance, who are: my grandmother, my father’s 3 sisters and my father himself. I would like this R40000 to be divided amongst the heirs when my father wishes to pay back the debt?

A:

This wealth will be distributed among the heirs of your grandfather according to the stipulated shares of inheritance. Your father’s share of the inheritance will remain with him.

This money will be divided into 40 equal shares and distributed as follows:

Your grandmother will receive 5 shares.

Your father’s three sisters will receive 7 shares each.

Your father will receive 14 shares.

And Allah Ta’ala (الله تعالى) knows best.
