Separated and Husband Promised to Divorce, is This Ṭalāq?

Question:

I have been separated from my husband for 9 months now due to domestic violence. I contacted him asking for my divorce. Due to having a child contact court case ongoing, he has written that he will give me divorce after the court case. In such a situation, is this a valid alāq as he already made the intention?

Answer:

In the described situation, Islamic divorce has not taken place. Divorce only takes place if the words of divorce are articulated by the husband with past or present tense terminology.
