Husband saying “Pack up and leave” intending talaaq

Q: My husband and I are having quite a lot of misunderstandings and always arguing etc. Last night he sent me a message saying its over and I must pack up and leave. Does that count as a talaq and does my iddat start immediately? Now he just messaged me again saying “its a divorce” so I’m confused as to whether I need to sit in iddat?

A: Since he intended talaaq through saying “It’s over. Pack up and leave!” one talaaq-e-baain (irrevocable talaaq) has taken effect. Your iddat has commenced from the time of the talaaq.

And Allah Ta’ala (الله تعالى) knows best.

الطلاق على ضربين صريح وكناية فالصريح قوله أنت طالق ومطلقة وطلقتك فهذا يقع به الطلاق الرجعي … ولا يفتقر إلى النية (الهداية 2/359)

وأما الضرب الثاني وهو الكنايات لا يقع بها الطلاق إلا بالنية أو بدلالة الحاللأنها غير موضوعة للطلاق بل تحتمله وغيره فلا بد من التعيين أو دلالته (الهداية 2/373)

Q: I just wanted to know that if I decide to go back home and make tings work, do we have to make nikaah again and when should I go back home?

A: Since your husband had issued one irrevocable talaaq, the nikaah had immediately terminated. If you and your husband wish to reconcile, then a new nikaah will have to be performed with a new mahr.

(وينكح ) مبانته بما دون الثلاث في العدة وبعدها بالإجماع ومنع غيره فيها لاشتباه النسب ( لا ) ينكح ( مطلقة ) من نكاح صحيح نافذ كما سنحققه ( بها ) أي بالثلاث ( لو حرة وثنتين لو أمة ) ولو قبل الدخول وما في المشكلات باطل أو مؤول كما مر ( حتى يطأها غيره ولو ) الغير ( مراهقا ) يجامع مثله وقدره شيخ الإسلام بعشر سنين (الدر المختار 3/409)
