Inheritance for Mother, Sister and Two Sons

Q: I would like to enquire on the following: My husband’s father has passed away a few years ago and in his family some monies have come their way in the form of inheritance due to some property sold. Their household consists of Mother, Sister and 2 sons. My questions are as follows as per shariah:

1. How should this inheritance be divided?

2. Is the mother entitled a share? if so, what percentage?

3. If the son who is married, must he consult with his wife if he wants to give a percentage of his inheritance to his mother?

4. Are they allowed to divide the inheritance equally. i.e sister & brother get the same share?


A: 1) The estate will be divided into six shares. The mother and sister will get 1 share each and the sons will get 2 shares each.
