Inheritance for sons and daughters

Answered as per Hanafi Fiqh by DarulUloomTT.net

Q. If a man who lives abroad got married but had to leave his wife for a year before the legal papers could be fixed. However when she went to live with him he realised after the first child was born it was not his. He decided to try to make the marriage work accepting the child as his own. He also had a son after that. He has been divorced from her for quite a while now. The children have now grown up and the first child in question is now married. My question is, should the inheritance between the two sons be equal? My second question is can I share my property between my two daughters before I die in any way I see fit or do I still have to share it based on Islamic law? I do not have any sons. Please advise.

A. With respect to the first question, the answer is that the two sons would be equal in receiving inheritance.

With respect to your second question, it is permissible for you to share your property between your two daughters before you die. However, in this case, you should try your best to be equal to each of them while giving property, wealth etc.

And Allah knows best.
