Custody Rights, Visitation and Interaction with a Drug Addict

Assalaamu’ Alaikum

I have just been informed that my son’s father has tested positive of drug use again. This is one of the main reasons of our divorce 7 years ago.

We now share custody of our son. I do not allow my son to go to his father after knowing this. I did give consent to my son to go to his uncles and have suggested supervised visitation for now but I am dealing with a person possibly under the influence.

I am looking into doing this legally because his father can pick him up from school etc anytime with our agreement now. I just wanted to know is this ok Islamically? Should I get full custody with supervised visitation? I would greatly appreciate your advice.

Can restrictions be placed upon the interaction of the father with his biological child in Islamic Shariah based on his addiction either on the grounds of him being a bad influence or based on purely Safety and Security concerns?

Please explain in some detail.

Answer

Wa’alaykum as Salām wa raḥmatullāhi wa barakātuhu,

If it is proven that the husband is a drug addict, then it is permissible to put restrictions on him. For the laws of custody, we will always look at what is in the best interest of the children themselves. Thus, since there is great possibility of the father influencing the child to also take drugs, or even harming him, it will be permissible to transfer the custody to others.


ثم اعلم أن الحضانة حق الصغير لاحتياجه إلى من يمسكه فتارة يحتاج إلى من يقوم بمنفعة بدنه في حضانته وتارة إلى من يقوم بما له حتى لا يلحقه الضرر وجعل كل
واحد منهما إلى من أقوم به وأبصر (البحر الرائق – 4 / 180

باب الحضانة : بفتح الحاء وكسرها : تربية الولد ( تثبت للأم ) النسبية ( ولو ) كتابية ، أو مجوسية أو ( بعد الفرقة ) ( إلا أن تكون مرتدة ) فحتى تسلم لأنها
تحبس ( أو فاجرة ) فجورا يضيع الولد به كزنا وغناء وسرقة ونياحة كما في البحر والنهر بحثا … ( أو غير مأمونة ) ذكره في المجتبى بأن تخرج كل وقت وتترك
الولد ضائعا ؛ وقال ابن عابدين رحمه الله: والحاصل أن الحاضنة إن كانت فاسقة فسقا يلزم منه ضياع الولد عندها سقط حقها وإلا فهي أحق به إلى أن يعقل فينزع
منها كالكتابية ( قوله : بأن تخرج كل وقت إلخ ) المراد كثرة الخروج ، لأن المدار على ترك الولد ضائعا والولد في حكم الأمانة عندها ، ومضيع الأمانة لا يستأمن
، ولا يلزم أن يكون خروجها لمعصية حتى يستغني عنه بما قبله فإنه قد يكون لغيرها ؛ كما لو كانت قابلة ، أو غاسلة ، أو بلانة أو نحو ذلك ، ولذا قال في الفتح :
إن كانت فاسقة أو تخرج كل وقت إلخ فعطفه على الفاسقة يفيد ما قلنا فافهم ( رد المحتار- 5 /259
