As a truck/taxi driver I complete 70 miles per day. Am I a musafir?

Question:

As salamu alaikum, I am a local truck driver and i do not drive farther than 30 miles from my home but cumulatively i drive more than 70 miles, am i considered a musafir or no? Jazakallah khair in advance

Answer:

Bismillahi Ta’ala

Assalamu alaikum warahmatullahi wabrakatuh,

In principle the consideration is given to the distance travelled beyond the city with the intention of travel to the distance amount that makes one a musafir.

Moreover, the consideration is also for the distance travelled one-way and not the return.

Hence, if a driver drives a cumulative distance more than the requirement of Safr but he has not gone beyond the safar-distance, he will still be regards as muqeem.

The example in such a case would be a taxi driver who drives well over the distance-safar during the day, but remains well within the distance-limit.

قال محمد – رحمه الله تعالى – يقصر حين يخرج من مصره ويخلف دور المصر، كذا في المحيط وفي الغياثية هو المختار وعليه الفتوى، كذا في التتارخانية الصحيح ما ذكر أنه يعتبر مجاوزة عمران المصر لا غير إلا إذا كان ثمة قرية أو قرى متصلة بربض المصر فحينئذ تعتبر مجاوزة القرى بخلاف القرية التي تكون متصلة بفناء المصر فإنه يقصر الصلاة وإن لم يجاوز تلك القرية، كذا في المحيط.
وكذا إذا عاد من سفره إلى مصره لم يتم حتى يدخل العمران ولا يصير مسافرا بالنية حتى يخرج ويصير مقيما بمجرد النية، كذا في محيط السرخسي.
ثم المعتبرة المجاوزة من الجانب الذي خرج منه حتى لو جاوز عمران المصر قصر وإن كان بحذائه من جانب آخر أبنية، كذا في التبيين.
وإن كان في الجانب الذي خرج منه محلة منفصلة عن المصر وفي القديم كانت متصلة بالمصر لا يقصر الصلاة حتى يجاوز تلك المحلة، كذا في الخلاصة (الفتاوى الهندية (1/ 139))
