Sex change

Answered as per Hanafi Fiqh by DarulIftaBirmingham

Can a girl change her sex from female to male? And after getting change her sex by operation can she marry to any other girl? If she marries what is order for that nikkah (please note that she is complete girl) and what is order for the persons who inspire her mentally and financially? Waiting for your reply thanks

In the name of Allah, Most Compassionate, Most Merciful.

Allah states in the Quran (that shaytaan said), “I will create in them false desires and order them to slit the ears of cattle. I will order them to tamper with Allah’s creation.” Therefore, whoever takes Shaytaan as a guardian instead of Allah, has indeed become a clear-cut loser.”  (Surah Nisaa: 119)

There is no doubt that changing the sex from female to male falls under the term of “tampering Allah’s creation” and therefore would be haram. Changing the sex through an operation would not alter the laws of shariah and she will still be regarded as a female and therefore will not be allowed to marry another female.

In regards to encouraging her mentally as well as financially Allah states in Surah Nisaa, “Whoever rallies to a good cause shall have a share in its blessing and whoever rallies to an evil cause shall be answerable for his part in it, for indeed, Allah watches over everything.” (Verse 85)

In conclusion, it is clear from the above that it is haram for a person to change their sex and also a person who encourages such a person, be it verbally, physically or financially, will also be sinful and held responsible in the sight of Allah.

Only Allah knows best.
