Personal Indemnity Insurance Haram?

Asalaamualaykum
I am currently working as an optician in the UK where we have to be covered with personal indemnity insurance by law, which gives us legal cover if we are sued by a customer. At the moment my employer covers this for me but I’m planning to change jobs and won’t be covered in my new job, so will have to become a member of an organisation who provide this insurance for opticians amongst other benefits. I am concerned it may fall under riba and gambling but it is required by law so is it halal?

Answer

Wa’alaykum as Salam wa rahmatullahi wa barakatuhu,

Insurance is not permissible, since it entails gambling and interest. However, since it is compulsory by law, you may pay the monthly installments for the insurance. However, in the unlikely situation that you have to claim – Allah forbid- it will be permissible for you to only take back the amounts that you paid. It will not be permissible to claim anything more, and if the insurance company does pay more than your total installments, you will have to give the additional amounts in charity, without the intention of reward.

ان اسباب و وجوہ کے تحت جمہور علماء کا نقطہ نظر یہی ہے کہ انشورنس کی مروجہ شکل حرام ہے

البتہ اگر کسی کو تھرڈ پارٹی انشورنس کی وجہ سے معاوضہ ملے تو اس کو صرف اتنا معاوضہ وصول کرنا اور استعمال کرنا جائز ہے جتنا اس نے پریمیم ادا کیا ، اس سے زیادہ استعمال کی اجازت نہیں (اسلام اور جدید معاشی مسائل –   3 / 317)

چونکہ گاڑی کے مالک کی طرف سے بیمہ کا معاہدہ بطیب خاطر نہیں بلکہ حکومت کی طرف سے یکطرفہ جبر و ظلم ہے لہذا بوقت ضرورت گنجائش ہے لیکن بصورت حادثہ جمع شدہ رقم سے زائد واجب التصدق ہے
