Divorce During Menstruation

Assalam o alaikum,

 
I had been married since 2002. We have two young kids ages 11 and 8. 
 
Back in 2005, my husband had said divorce once but since I was on my period, the shaykh had said it had become invalid.
 
My husband wants legal separation now in 2020 according to the American court system. I would like to have a fatwa for this. 
 
What is the American legal separation mean in Islam
 
I need to know if legal separation according to court is considered a valid divorce according to Shariah. 
 
Will the previous divorce count
 
Do I need to do iddat when the court grants us legal separation

It is considered impermissible and a sin to issue divorce to a woman who is in the state of impurity (menstruation). However, if issued, such a divorce still takes effect. Therefore as per the situation described in your question, the divorce issued in 2005 is considered valid. If ruju (reconciliation) was not performed during the period of ‘iddah then from a shar‘ai standpoint the husband and wife are considered strangers to each other. If they want to seek legal separation there is no harm in doing so. There is no need for performing ‘iddah after that either. However, if you have a question regarding the nature of the divorce which took place in 2005 or the period of ‘iddah thereof, you can ask a separate question with relevant details for that.

(قوله وتجب رجعتها) أي الموطوءة المطلقة في الحيض (قوله على الأصح) مقابله قول القدوري إنها مستحبة لأن المعصية وقعت فتعذر ارتفاعها، ووجه الأصح قوله – صلى الله عليه وسلم – لعمر في حديث ابن عمر في الصحيحين «مر ابنك فليراجعها» حين طلقها في حالة الحيض، فإنه يشتمل على وجوبين الخ {ردالمحتار مع درالمختار} إذا طلق امرأته في حالة الحيض كان عليها الاعتداد بثلاث حيض كوامل ولا تحتسب هذه الحيضة من العدة كذا في الظهيرية.{فتاوی ہندیہ}
