Notwithstanding the fact that the subject of RIBA, interest between a Muslim and a Harby Kafir has been controversial in old and new ages and also there remain arguments and counter arguments of highest level in this topic yet, in the brochure, RAFI’UDH DHANK AN MANAFI’IL BANK written by Hakim ul Ummath Moulana Ashraf Ali Thanwi Sahib Rahimahullah in IMADADUL FATAWA, it is established explicitly with concrete proofs that the permissibility of “Riba based transactions between a Muslim and a Harby in a Harby land” is not in all cases openly but subject to some conditions and the conditions are laid down in Imdadul Fatawa. In the light of these conditions it is impossible to declare the decree of permissibility of Riba based transactions between a Muslim and a Harbi in non-Muslim states nowadays. The view of Hadhrath Thanwi Rahimahulla too is picked only due to the fact that it is based on solid proofs. Further, it is also worth mentioning that Islamic Banking is available in different countries of the world and by acquiring their services one can protect the capital, rather obtain Halal income as well and also save from committing a grave sin like Riba.
Therefore rather than trying to find excuses to make “Riba based transactions between a Muslim and a Harby in a Harby land” permissible, Muslims should adhere to earn profit from permissible avenues which is not even difficult nowadays.
