Does ejaculation break the Fast

Answered as per Hanafi Fiqh by DarulIftaBirmingham

Regarding kafarah of missed fast, during fasting ,since I stayed alone I use to go to chat room and sometimes chat with opposite sex and also sometimes watch movies, at that time I will get erection and wet ,I don’t use my hands to my penis. It will just get erected and ejaculate. Sometimes I might hug my pillow and between my thighs and before zohar I will do ghusl .This act is similar to masturbation .I think for 3 years totally I might have done maximum 20 days like this. I have to fast for 20*60 days (1200 days for almost 3 years continuously) or can I go for alternative of feeding the poor. What is punishment for a person in hell for missing the fast or doing qada in hereafter

Answer:

In the name of Allah, the most Beneficent, the most Merciful.

Regarding your question, if one ejaculated by means of masturbation then ones fast will break however there is only qadha and no kaffarah (expiation). The same rule also applies if a person ejaculated after touching or kissing his wife. (Fatawa Darul Uloom Deoband p.417 v.6)

Kaffarah is only compulsory if someone breaks the fast of Ramadhan intentionally by eating, drinking or engaging in sexual intercourse. (Kitabul Fiqh p.906 v.1)

In masturbation, a person is only deriving a partial enjoyment or benefit compared to full sexual intercourse.  Therefore, the jurists have said that only qadha will be done for the fast broken through masturbation and there will be no need of a kaffarah.  (Maraqi Falah)

However, if one ejaculated without forcing the semen out with one hands or by rubbing his private parts on the pillow then the fast will remain intact. As long as one did not rub the pillow with his private parts, merely placing the pillow between the thighs does would not break the fast. (Jawahirul Fiqh p.379 v.1)
