Does eating and drinking anything due to waswasas break the Fast

Answered as per Hanafi Fiqh by DarulIftaBirmingham

Asalamu Alykum I have a question related to fasting I have learnt that if someone deliberately eats or drinks some food during his fast he has to repeat the day and also an expiation of 6o days but if someone who is effected by waswaas eats or drinks and does not think what he is doing is expiation also required in this case or to fast only that day as he is effected by strong waswaas

Answer:

In the name of Allah, the most Beneficent, the most Merciful.

If a person broke his fast by eating and drinking due to doubts or waswasas then his fast will not break. It is similar to the fast breaking out of forgetfulness. Forgetfully means that one does not have the presence of mind that one is fasting when performing the action. (Maraqi Falah p.238)

The Prophet of Allah ṣallallāhu 'alayhi wa sallam (peace and blessings of Allāh be upon him) said, “Whoever forgets that he is fasting and eats or drinks, and then he still completes his fast. It is only Allah who fed him and gave him drink.” (Sahih Bukhari)
