Forms of Fornication

Answered as per Hanafi Fiqh by Askmufti.co.za

Q: Does the pleasuring of private parts via hand, tongue hold punishment by hadd (Islamic capital punishment)? Does it fall under the category of fornication? And what about kissing? How can one have such disgusting sins forgiven? Because I have read that forgiveness for a major sin is not guaranteed.

A: Although sinful, it is not punishable by Hadd. It does fall within the category of fornication but also not punishable by Hadd.

Hadeeth:

It is narrated from Sayyidina Abu Hurayrah (Radhiyallaahu Anhu) that Rasulullah (Sallallaahu Alayhi wa Sallam) said:

Fornication (Zina) of the eyes is the gaze. Fornication of the ears is to listen. Fornication of the tongue is the speech. Fornication of the hands is to touch. Fornication of the feet is to walk, and the heart desires and hopes. The private part either confirms it or negates it. (Muslim V8 P52)

If a person sincerely repents for any sin, he must firmly believe that it has been forgiven.

It is mentioned in a Hadeeth that when a person seeks forgiveness from a sin, it is as if he did not commit that sin at all. (Ibni Maajah V2 P1419).

At the time of seeking forgiveness (Taubah) keep the following points in mind:
* You should not be involved in the sin at the time of Taubah.
* You should have regret and remorse over your sins.
* You should promise Allah Ta’aala that you will not return to that sin again.

Any sin, irrespective of how big it is, is forgiven through making Taubah. Turn towards Allah and He will turn towards you.

A person should resort to Taubah after committing a sin and make a promise unto Allah Ta’aala that the sin will not be committed again. Sins are forgiven and cleared from ones name through sincere Taubah. If one is by the means, give out some Sadaqah. Sadaqah extinguishes the wrath of Allah.
