An Insulter of Nabi (S.A.W.)

Answered as per Hanafi Fiqh by Mahmoodiyah

Question:

Assalamualaikum, What do Ulamaa of Ahlus Sunnah wal Jamaa’ah say about searching the Niyyah or Qasd-e-Qalb of an insulter and belittler of
Rasoolullah Sallallahu alaihi wa sallam before branding him a Kaafir and Murtad. Bayyinu from Kitaab and Sunnah and Toojiru.

Answer:

Firstly, we should closely study the words uttered. If the statement could have a number of meanings or different possibilities then we will inquire from him as to what was his intention, before branding him a Kaafir. If, through his intention it is evident that he did not insult the Nabi of Allah (S.A.W.) and it does not result to apostasy, then we will not classify him a Kaafir. However, he should make sincere Taubah, renew his Nikah as a precautionary measure and if the Hakim (Judge) is a Muslim then he should punish him.

On the contrary, if his intention clearly indicates that he has committed apostasy, then he will be braded as a Kaafir and apostate. He should be instructed to renew his Imaan and Nikah, and punished if the leader is Muslim.
