Rukhsatee after Nikaah

As salamu alaykum
Please advise
If nikaah is performed but girl goes to live with the husband only after a while. In the interim are they allowed to meet etc. What will be permissible and are there any restrictions ?

Answer

Wa’alaykum as Salam wa rahmatullahi wa barakatuhu,

Once the Nikah takes place, it is permissible for the newlywed couple to enjoy full marital rights. Even if they prefer living together only after some time, they are free to speak to each other, meet and even have intercourse in that period, provided no party stipulated any conditions or restrictions beforehand. If either of the spouses stipulated any condition (example: no meeting), then that condition has to be honoured.

During the period between the Nikah and Rukhsati (when the wife goes to live with her husband),  the husband will not be responsible for maintaining his wife or providing her shelter and clothing. Likewise, the husband will not have a right to demand that his wife should come earlier than the stipulated period.

In short, during the Rukhsati period, the husband and wife are free to enjoy all things which are made permissible by Nikah, but both parties have to honour all prior agreements.

نکاح میں لگائی  جانے والی شرطیں بنیادی طور پر تینن طرح کی ہیں:

تیسری قسم:ایسی شرطیں ہے جن سے  عورت کو نفع پہنچتا ہو  اور شریعت نے نہ انکو واجب قرار دیا ہو  اور نہ انسے منع کیا ہو۔ گویا  ان شرطوں کو  مان کر مرد  اپنے بعض ایسے حقوق سے دستبردار ہو جاتا ہے۔جن سے دستبردار ہونے کا  اسکو اختیار ہے  (جدید فقھی مسائل  18/3)
