Musical Instruments

Answered as per Hanafi Fiqh by CouncilofUlama.co.za

Q: Would like to know if purchasing a piano or organ instrument Halal or Haraam and is there proof from the Shari’ah regarding this matter?

A: It is not permissible to purchase these musical instruments.

The impermissibility of music is proven from both Quran and Ahadith. Consider the following examples. Allah Ta’ala mentions:

(From amongst men there are those who purchase ‘lahw al hadith’ without knowledge, to mislead from the Path of Allah and they ridicule it. For them there is a humiliating punishment). (Luqmân: 6)

The following great Commentators……

1) Abdullâh ibn Mas‘ûd radiyallâhu ‘anhu
2) Jâbir ibn ‘Abdillâh  radiyallâhu ‘anhu
3) Abdullâh ibn ‘Abbâs radiyallâhu ‘anhu
4) Hasan al-Basrî rahimahu Allah
5) Ikrimah rahimahu Allah
6) Sa‘îd ibn Jubayr rahimahu Allah
7) Mujâhid rahimahu Allah
8) Amr ibn Shu`ayb rahimahu Allah
9) Ali ibn Badhîmah rahimahu Allah
10) Habeeb rahimahu Allah
11) Makhûl. rahimahu Allah

…state that the verse in reference refers to music. (Tafseer Ibn Katheer 3/411, Musannaf Ibn Abi Shaybah  5/132)

In another verse Allah Taala says:
(Arouse those whom you can amongst them with your voice; make assaults upon them with your cavalry and your infantry; share with them (their) wealth and children; and make promises to them. But Shaytân promises them nothing but deceit.) (Banî Isrâ’îl: 64)

In the tafsîr of Mujâhid ibn Jabr the “voice of Shaytân” has been interpreted as “songs and flutes”.

It is stated in a hadith (Bukhari 18:447):
Abû `Amir (or Abû Mâlik) al-Ash`arî mentions that Rasûlullâh sallallâhu ‘alayhi wasallam said:

(Indeed, there will be in my Ummah such people who will regard as permissible for themselves fornication, silk, wine and musical instruments…..)
