Inheritance and Business Issue

Answered as per Hanafi Fiqh by CouncilofUlama.co.za

Q: 1. With regards to inheritance how do we divide the following amount of the father’s share between his wife, 1 daughter and 4 sons? The amount is : R4474.00.

2. With regards to making a profit of money. I have R200 000 and wish to enter into a partnership with my friend wherein I give him that money and also give him permission to buy and sell good with that money and then split the profit between us. Is this permissible for us to do, what is the shariah ruling regarding such a partnership?

A: 1) The wife will get one eight and the balance must be divided among the children with the sons getting double of what the daughters would receive. So each son will get R874.91 and the daughter will get 437.45 and the wife will get 536.88. All this will be correct if the deceased did not leave any parents.

2) The transaction is fine and it is called mudaarabah.
