Can I remain with my wife after 4 months if I gave her a ‘FIRST TALAQ’?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
Please give me the answer of my question (1) If I say to my wife that today I am giving you a ‘FIRST TALAQ”, then in this position can I remain with her after 4 months? Or totally talaq had done and now she is haram for me.

Answer

(Fatwa: 487/487/M=1433)

As a result of the said word, one talaq raja’i shall take place on your wife. In talaq raja’i, the husband has the option to take his wife back within iddah period. She shall remain your wife as usual if took her back before iddah i.e. passing three menstruating period. And if the wife is pregnant at the time of talaq, then the option of taking her back will continue before she gives birth to the child.
If you did not take her back within iddah then she shall become divorced with bainah talaq i.e. the option of taking her back shall come to an end. Then, if they want to live together, they will have to do new nikah with mutual consent. It should be noticed that gving talaq unnecessarily is abhorrent and disliked.
