Making bina in Salaah

Q: My question is regarding a woman doing bina if she involuntarily breaks her wudhu in Salaah. One of the conditions of bina is that the satr should not become uncovered for bina to be correct. But if the woman goes to redo her wudhu she will uncover her arms and head and ankles etc to do wudhu, so would this still mean the bina is valid?

Bismillaah

A: When making bina, a woman is forced to expose her hands in order for the wudhu to be valid. If she does not expose her hands and wash them, then the wudhu will not be valid. Hence we understand that this is something unavoidable. When it is unavoidable, then permission has been granted to her from the side of Shari’ah. There are many other things which are also done while making bina which go against the dictates of the Salaah, (e.g. a woman opening her hair to make masah, turning away from the qiblah, walking to the place of wudhu) however all these things have been overlooked while making bina since they are unavoidable. Hence, according to the preferred opinion in the Hanafi mazhab, a woman is permitted to expose her hands and wash them while making bina.

Nevertheless, since there are many conditions that have to be adhered to when making bina and if any of the conditions are not met the Salaah will not be valid, we advise that one makes wudhu and commences the Salaah from the beginning so that one is sure that one’s Salaah has been performed correctly.

اعلم أن لجواز البناء ثلاثة عشر شرطا : كون الحدث سماويا من بدنه غير موجب لغسل ولا نادر وجود ولم يؤد ركنا مع حدث أو مشى ولم يفعل منافيا أو فعلا له منه بد ولم يتراخ بلا عذر كزحمة ولم يظهر حدثه السابق كمضي مدة مسحه ولم يتذكر فائتة وهو ذو ترتيب ولم يتم المؤتم في غير مكانه ولم يستخلف الإمام غير صالح لها … ( ولا ) يستخلف إجماعا … ( أو كشف عورته في الاستنجاء ) أو المرأة ذراعها للوضوء ( إذا لم يضطر له ) فلو اضطر لم تفسد

قال الشامي : ( قول إذا لم يضطر له إلخ ) قال في الخانية قال الإمام أبو علي النسفي إن لم يجد بدا من ذلك لم تفسد صلاته وإلا بأن تمكن من الاستنجاء وغسل النجاسة تحت القميص فسدت وكذا المرأة لها أن تكشف عورتها وأعضاءها في الوضوء إذا لم تجد بدا من ذلك وقال بعضهم إذا كشف عورته في الوضوء لا يبني وكذا المرأة والصحيح هو الأول لأن جواز البناء للمرأة منصوص عليه مع أنها تكشف عورتها في الوضوء ظاهرا اهـ قال نوح أفندي وصحح الزيلعي الثاني والاعتماد على تصحيح قاضي خان أولى ولهذا اختاره المصنف يعني صاحب الدرر اهـ لكن في الفتح عن الزيلعي أن الفساد مطلقا ظاهر المذهب (رد المحتار 1/ 599-604)
