Talaq in anger

Answered as per Hanafi Fiqh by Tafseer Raheemi

Question: If your husband says talaq to you in a fit of anger and only you hear it no one else and then he apologises straightaway and also denies it i didnt say it like this etc etc what should you do?

Answer: Talaq is only given in anger, nobody says “Begum I love you, so i’m giving you talaq” therefore, the talaq will take effect even if he was in a fit of anger and nobody else heard it. Apology is of no use.

If you definitely heard him say it, then, if he said it only once and he wants to stay with you, he may do so, however this talaq will stay in his books, ie. If he gives another one after some time, it will be added to the first one, and if gives another one for a third time, then there will be no room for reconciliation. All three will be added up.

If he said it three times, then you are both finished, you should stay away from one another immediately. Any passionate contact will be classed as zina. Seek help from your family members or others to get the marriage dissolved.

People will tell you about halala, but that is not a recommendation of shariah, let alone it being a command.

May Allah help you and take care of you through such turbulent times. Ameen
