IN THE NAME OF ALLAH THE MOST BENEFICENT AND THE MOST MERCIFUL
If the questioner and his brother are dependents of their father, then the rooms which were built in his land while father was alive had become the property of their father on the basis of beneficence, benevolence and co-operation shown towards their respected father on behalf of the children. As long as he was alive, he had been the sole owner of these rooms. Therefore, now after his demise, all these rooms including the land is counted in his legacy and will be divided among all his children, sons and daughters as per their share.

Allah knows best.
