Saying I want to divorce you
Question
If a husband says to his wife: ‘I want to divorce you’, will the divorce take place?

Answer
Saying ‘I want to divorce you’ does not constitute divorce. Wanting and desiring to do something is different from actually doing it.
This does not mean that one should say such phrases. Such statements are not conducive to marital relations and hurt the feelings of the spouse. They should therefore be avoided.
قال السرخسي في المبسوط (٦/٢٠٢): لو قال أحببت طلاقك أو هويت طلاقك أو أردت طلاقك لا يقع به شيء، وإن نوى فكذلك لا يصير مملكا منها بهذا اللفظ شيئا، انتهى. وقال المرغيناني في الهداية (١/٢٤٢): بخلاف قوله أردت طلاقك لأنه لا ينبئ عن الوجود، انتهى. وذكر ابن مازة في المحيط البرهاني (٣/٢١٠) عن المنتقى: ولو قال: نويت طلاقك أحببت طلاقك رضيت طلاقك أردت طلاقك لا تطلق وإن نوى، انتهى. وقال الفخر الزيلعي في التبيين (٢/٢٢٨): الإرادة لغة عبارة عن الطلب. قال: وليس من ضرورة الطلب الوجود، انتهى. وراجع البحر (٣/٢٧٠) ورد المحتار (٣/٣٣٥)۔
